1) 광고주가 자신이 광고에서 주장할 내용에 대하여 그것이 사실임을 뒷받침하는 객관적이고 합리적인 근거를 가지지 않고 광고를 한 경우, 당해 광고를 미실증(未實證)광고라 한다. 동 광고내용이 사후에 진실임이 판명되더라도 마찬가지다.
2) Unfair methods of competition in or affection commerce,and unfair or deceptive acts or practices in or affecting commerce, are hereby declared unlawful.
3) 광고실증명령은 광고주가 합리적 근거없이 장래의 광고에서 상품 등에 관한 적극적인 주장을 하는 것을 금지하는 명령을 말한다. FTC는 일반적으로 광고실증명령과 함께 광고상의 주장이 실제로 실증되었는지의 여부를 평가하기 위한 보조수단으로서 최후의 주장이 있은 후 3년간 그 주장을 뒷받침하는 자료를 보유하고 위원회의 조사와 열람에 제공할 것을 명령한다.
4) 미국의 경우에도 판례는 “FTC가 법집행절차 또는 처벌절차에서 피고(사업자 등)에게 입증책임의 부담을 전가시키는 명령을 발하는 것은 피해구제권한을 넘어서는 것”(Federated Nationwide Wholesalers Service vs.F.T.C.,398 F.2d 253,260(2d Cir.1968))이라고 판시함으로써 FTC에 대하여 입증책임을 부담시키고 있다.

6) 영국의 거래설명법(Trade Descriptions Act)제3조에서는 표시가 ‘중대한 정도로 사실에 반한 때’에 한하여 허위광고로 하고 있다.

8) 과태료는 행정상의 질서위반행위에 대한 제재로서 행정법상의 의무에 대한 위반의 정도가 비교적 가벼워서 직접적으로 행정목적이나 사회목적을 침해하지 않는다 하더라도 간접적으로 행정상의 질서에 장애를 초래할 위험성이 있을 정도의 단순한 의무위반에 대해 과하는 일종의 금전벌이다(박영도,박수헌,1993,p.31)
